PICKUP TRUCK ROLLOVER AFTER TIRE TREAD SEPARATION KILLS TEXAS MAN

WILLIS LAW FIRM ROLLOVER CLIENT: Baker vs..General Tire Company, et al.

Facts: This pickup truck rollover occurred on May 17, 1994, while Mr. Baker was driving home from work. The 20 year old Dallas resident was killed when his back left tire on his Chevy Sierra Classic Truck blew out at highway speeds on S.H. Loop 12 in Dallas, Texas. According to the investigating police officer, the back tire's tread separated, causing the blowout and resulting in a loss of control and deadly pickup truck rollover. The pickup truck's roof collapsed and intruded into the occupant space. The tire was manufactured by General Tire Company. The Chevrolet pickup truck's tire tread came off on the road surface shortly before the roll. The pieces of the tire were gathered and saved by the officer who later turned them over to the family's attorney, David P. Willis of Houston, Texas. After expert consultation and thorough investigation, it was determined  that the tire's tread had separated as a result of improper adhesion and bonding at the factory. General Tire's experts disagreed, stating the tire was just worn out. However, after many months of legal battling, the parties entered into a Confidential Settlement.

When a radial tire suddenly loses it's tire tread the driver often loses of control of the vehicle due to a blowout of the tire or rapid pressure decrease in the remaining core. When the blowout occurs to a rear tire, controlling the vehicle becomes very difficult, especially at highway speeds. This loss of control results in the rear of the vehicle swinging around to become perpendicular to the direction of travel (yawing). If the yawing is not immediately reversed in direction, then the sideways motion often leads to the bead of the tire separating from the rim or de-beading, allowing the rim to dig into the pavement or surface, resulting in propelling or tripping the vehicle into a roll. Tripping of the vehicle can also result in a rollover if sufficient amount of sideway movement occurs in a grass or dirt median to actually trip the vehicle and launch it into a rollover. Tire manufacturers have known that a leading cause of tread separation is due to the design and placements of the belts and overlying tread.
